Following up from our session in April, in this update we will discuss what employment-related legislation has progressed, what is new, and what the possible implications are for both private and public sector organisations, and with employees.

We aim to cover the following topics, with scope to add anything further that might develop before the seminar:
 • The Employment Relations Amendment Bill (currently in the Select Committee phase) which covers:
   o  a proposed income threshold for unjustified dismissal personal grievances;
   o  the introduction of a gateway test to distinguish independent contractors from employees; 
   o  the removal of the ’30 day rule’ regrading collective agreements; and
   o  a change to eligible remedies for personal grievance claims.

 • The Employment Relations (Termination of Employment by Agreement) Amendment Bill (also at Select Committee stage) which would change the way employers and employees are able to engage with each other in terms of exit negotiations.

 • The Privacy Amendment Bill (awaiting its Third Reading) aims to improve transparency about the indirect collection of personal information by introducing a new information privacy principle.

 • An overview of Health and Safety developments, including Worksafe’s Managing Psychosocial Risks at Work guidelines.

 • And some insight into what effect the following new legislation will have in day to day operation:
   o  The ending of pay secrecy in remuneration disclosure;
   o  How making 90-day trial periods available to all employers affects employees; and 
   o  How a pay deduction works practically when partial strikes occur.

We encourage you to bring your own stories.  These sessions are best when we are discussing real life situations in the context of amendments to employment law!

Tess is a partner at JB Morrison Lawyers and leads the employment law team. She works with employer and employee clients on all employment law issues. Tess has a wide range of experience across all aspects of employment law – including disciplinary issues, performance management, personal grievances, restructuring and redundancy, investigations, parental leave, health and safety, salary and wage matters, employment agreements and restraints of trade. Tess is experienced in mediation, the Employment Relations Authority, and has appeared in the Employment Court. Tess partners with her clients to assess issues with legal and practical considerations in mind. She provides tailored and pragmatic advice to achieve the best possible outcomes. Tess has a particular passion for tailoring all advice to her particular clients and their circumstances and needs. Tess regularly presents seminars and enjoys partnering with businesses to conduct issues-based training for management to upskill them in employment relations matters. Angela Williams is a Senior Associate and Sam McGuire is a Solicitor in the employment law team at JB Morrison Lawyers.
