  • Employment Relations Amendment Bill:
         o    Gateway test for independent contractors – clarification of the definition of an “employee”
         o    Reduction of remedies available for employees in certain circumstances – greater weight placed on the behaviour of the employee.
         o    Removal of unjustified dismissal protections for high income employees
         o    Removal of the “30 day rule"
  • Proposed changes to the Holidays Act
  • Proposed changes to without prejudice discussions – (Employment Relations Termination of Employment by Agreement Amendment Bill)
  • Upcoming changes to pay secrecy law (Employment Relations Employee Remuneration Disclosure Amendment Bill). This passed the third reading and will come into force in the next few weeks
  • New obligations on employers regarding employment agreements (Regulatory Systems (Immigration and Workforce) Amendment Act)
  • Introduction of a criminal offence for withholding payment to an employee
  • Recent Case roundup (a focus on recent decisions of interest for employers)

Marty is a Consultant and former Partner at Pitt & Moore Lawyers. With more than 25 years’ experience in dispute resolution/litigation, Marty has appeared in a wide range of Courts and Tribunals up to solo appearances in the Court of Appeal. Marty’s track record includes major cases for leading companies, across a range of industry sectors. In addition to specilising in employment law, he also has expertise in all areas of regulatory law and is an expert in health and safety, maritime, aquaculture and fisheries law, insolvency and Māori land law as well as insurance law.

Heather Collins - Associate, Pitt & Moore
Heather Collins - Associate, Pitt & Moore

Heather is an Associate at Pitt & Moore Lawyers. She specialises in employment law and has over 15 years’ experience advising corporate and individual clients on broad range of workplace matters. Heather regularly assists with raising and defending personal grievances, disciplinary and performance issues, restructuring, redundancy, incapacity, contractual disputes, health and safety, protected disclosures, privacy, holiday and leave entitlements, and restraints of trade, in addition to providing representation at mediations and in the Employment Relations Authority. Heather also regularly advises employers on overall employment law compliance, and drafts and updates employment agreements, contractor agreements and workplace policies. Heather has presented at a number of national and local conferences on the topics of employment law and immigration law (which she also specialises in), and she has particular expertise in advising clients and other professionals on issues where employment and immigration law overlap.
